I'm posting this video from True Crime Rocket Science, who did a fine job arguing for his opinion that the flashlight on the kitchen counter is misdirection.

The flashlight misdirection proposed by Nick van der Leek in the video above actually reinforces how ridiculous the intruder theory is.
Let's use some brute force logic on that flashlight: Since the flashlight itself was wiped for prints, as were the batteries, it makes no sense it was brought in by the police after the fact. This leaves us with only two possibilities if we believe the intruder theory.
#1 An intruder brought it in. If the intruder came in via the basement and left this way, how did he find his way out after leaving the flashlight on the kitchen counter? The flashlight being in its upright position indicates whoever put it there was in no hurry. It simply makes no sense he would leave the flashlight behind. Even if this intruder was so well prepared that he wiped both flashlight and batteries clean, and handled them with gloves. The way Jonbenet was killed shows that he (assuming it's a he) spent some time inside the house so there was plenty of time to retrieve the flashlight before leaving. Worst of all, where was the Ramsey flashlight if not in its place in the drawer!
#2 It was already in the house. Well, the intruder would then have entered in complete darkness and then retrieved it from the drawer. How did he know which drawer to pick? And why wipe the batteries before leaving it upright on the kitchen counter? Why not simply take it with him and dump it somewhere? An intruder being in possession of the Ramsey flashlight makes no sense at all.
None of them work by any stretch of the imagination. The key clue is that the batteries were wiped. Note that John told that they were usually dead. I'll bet that whoever used that flashlight possibly changed and wiped the batteries so it would seem like it was brought in by an intruder. I very much doubt that Burke would have the IQ to come up with this; his fingerprints were left on the bowl of pineapple. Also, I don't see why the Ramsey flashlight should have been in use prior to whatever happened to Jonbenet.
Further, the way Patsy responds during the questioning suggests she is completely out of the loop concerning the flashlight even though she and John have had months to get in sync. It wouldn't surprise me if John staged the flashlight on the counter but never told Patsy. I'm 100% sure that John used the flashlight, and he kept Patsy in the dark. It's obvious to me that Patsy is winging it, unsure where this is going, and latching on to whatever they are feeding her.
John was ready to throw her under the bus if there were any danger of him being dragged down, hence no need to let her in on why his flashlight was out of the drawer!
