I cannot survive in this world unless I know I have my American way of life and can start from the very beginning. I have to work into this. I cannot answer these questions like in a court, yes or no. And I will not answer yes or no. I want to tell you the story. And that is the only way you can get a true picture. I am the accused mother of this man, and I have family and grandchildren, and Marina, my daughter-in-law. And I am going to do everything I can to try and prove he is innocent. Mr. RANKIN. Well, now, Mrs. Oswald, you are not claiming before this Commission that there was anything back at the beginning, at the early childhood of your son, in which you thought he was an agent? Mrs. OSWALD. Yes, sir--at age 16. Mr. RANKIN. She was the second witness called after Marina. From the time of Lee's defection (1959), until her death, (1981) she believed her son was an agent. Here, she was allowed to ramble, without an outline of investigation, or direction to bring to point. The members took what they needed to complete their task. In studying the dialogs of the commission, it is easy to see they took a strong lead when they knew what they wanted. And often times, led the witness exactly where that was. In contrast, there were times, they knew the witness could say things damaging to the conclusion. Or worse, the witness could bring evidence damning to the agencies however involved. That must be wiped out. These last 4 pages prove the process was very careful not to ask questions that scope in any further investigation. It was a charade, really. But there was no other witness leading the direction of questions like Marguerite. And, I don't think there was any question they asked, that they didn't already know the answer to. although there were a few surprise statements along the way. ++++++++++++++++++++++++++++++++++++++++++++++++++++++ "I Led 3 Lives"Mr. RANKIN. He was being prepared to become an agent, and inspired by this recruiting officer? Mrs. OSWALD. Yes, sir. Mr. RANKIN. By what you have told us about his reading the communist literature and this one pamphlet, and also the manual of the Marine Corps? Mrs. OSWALD. Yes, sir. And then living to when he is age 17 to join the Marines, which I knew, and which he did at age 17 on his birthday. Mr. RANKIN. Now, what else do you base your idea that he was ever became an agent or was going to become an agent on? Mrs. OSWALD. Many, many things. We always watched--it is "I Led 3 Lives" --the program--Philbrick. We always watched that. And when Lee returned from the service and the Marines, the three days--that program was on, and he turned it off. He said, "Mother, don't watch that, that is a lot of propaganda." It has been stated publicly that the FBI did not know--didn't have Lee on the subversive list-- I am probably not saying this right, gentlemen--but the right wing in Dallas. I don't know anything politically. The FBI and Secret Service had a list of names in Dallas of people that had to be watched, and Lee Harvey Oswald was not on that list. That would lead to believe there was some reason he was not on the list. Mr. RANKIN. Who did you get that from? Mrs. OSWALD. From the newspapers and all over. And there has been a lot of comment about this all through. Now, I don't say it is correct. But what I have explained to you before my way of thinking has to go with this, because I know the boy and the whole life, and you do not, sir. Mr. RANKIN. The NY Times reported, Oswald was not under surveillance at the the time of the assassination. FBI records indicate otherwise. The Dallas division of the FBI was already trying to track Oswald in October 1963, according to memos by the New Orleans division. It is unbelievable, they didn't know by 11/22, that he was in Dallas. The end of Oct '63 and no word to the PRS. "The Protective Research Service (PRS) was meant to function both as repository of information about threats to the security of Secret Service protectees and as a provider of such information to agents in all types of assignments." (HSCA)HSCA(Roy) Kellerman also testified to the HSCA about an inquiry in Dallas which was conducted prior to November 22, in order to locate anti-JFK subjects. When asked specifically about right-wing individuals, scurrilous literature, and extremist groups known to be in Dallas, he claimed virtually total ignorance. (209) He insisted that no one told him anything about an investigation of threat information submitted to the Secret Service in Dallas on November 21 and 22 by the FBI. The FBI bailed Lee out on the Bringuier scuffle. TheyI were aware of a woman driving to New Orleans (Paine - helped pack the car) and Marina leaving. No Lee. Next, reports of Lee Oswald calling and showing up at the Soviet Embassy in Mexico City. 24/7 surveillance in Mexico City, no photo of him. Telephone calls, cannot confirm his voice. November 1963, there are threats to the president in Dallas, "WANTED FOR TREASON" posters. A teletype out of New Orleans warned JFK could be assassinated in Texas. All the FBI informants in Dallas that had information around Lee, designated as T-1 T-2 and so on.... Where is that FBI handle on Oswald? They had him in New Orleans. Can they really not find this guy?

Could we get what picture this is?On Saturday, Nov. 23, Marina, Marguerite Oswald, and the children, were hiding from the press at the local Executive Inn. Lee was still alive, and being held without a lawyer at the Dallas Jail. According to Marguerite, the only one that knew where they where was Mrs. Paine. She must have tipped off the FBI. Bartwell Odum visited about 6:30p (She called him Hart Odum)Odum wanted to show Marina a picture. Marguerite wouldn't allow it. About an hour after Odum, Mrs. Paine called, and Marina gave Marguerite the cold shoulder. Marguerite insisted the two events were connected, and the picture meant some kind of threat. The picture above is what Odum said he showed Marguerte. A photograph of a mystery man in this case, from the Soviet Embassy at Mexico City, at a time Lee Oswald was supposed to be be there. The commission didn't have the photo on the 10th. Dulles interjected with the request. Then Marguerite told them, the man in the photo Odum showed her, was Jack Ruby. This is a very glossy black and white picture of a man's face and shoulder. Now, Mr. Odum wasn't too tall. I need somebody else. Mr. Odum's hand with the picture-- what I am trying to say--he is facing this way--showing me. So my eyes are looking straight at the picture. And I have nothing else to see but this hand and the picture, because the door is ajar. And there is nothing on the picture but a face and shoulders. There is no background or anything. So I can identify this picture amongst millions of pictures, I am so sure of it. It was a glossy black and white picture. So I said, "No, sir, believe me. I have never seen this picture in my life." With that, he went off. There was another man with him. About an hour later the telephone rang, and it was Mrs. Paine. She said, "Mrs. Oswald, Lee called and he was very upset because Marina was not with me, and he asked me to get a lawyer for him, a Mr. Abt. I would like to talk to Marina." So I put Marina on the telephone, and Marina said about two or three words. So when she got off the telephone, I said,--Now, Marina talks in Russian, gentlemen. I said, "Marina, Mrs. Paine told me that Lee called and you were not home at Mrs. Paine, and Lee tells Mrs. Paine to get a lawyer." Marina didn't answer. And I then sensed--well, now, why isn't she answering me? This is very peculiar. And there was no more said about that conversation. There was no reason to think the Odum visit and the Paine call were connected. Marguerite was associating what little she had, while her mind wandered into wild assumptions. Connecting the FBI, with the man she now knows as the notorious Jack Ruby, and the killing of her son. Dulles requested the picture, it was ready for the 12th. Mr. DULLES. Could we get what picture this is? Is that the picture held in the hand? Mrs. OSWALD. Yes, sir--the picture that is held in the hand, that the FBI agent, Mr. Hart Odum showed me. Mr. RANKIN. I understand you didn't recognize who the picture was at all. Mrs. OSWALD. No. I told Mr. Hart Odum I had never seen the man before, "Believe me, sir," and he left. So the picture was shown--was tried--had tried to be shown to my daughter-in-law, but they were not successful. So then they received--Marina receives a telephone call. Now, I am under the impression, since I know it was Mr. Jack Ruby's picture I saw--at the time I didn't. Mr. RANKIN. How do you know that? Mrs. OSWALD. Because I have seen his picture in the paper. Now I know it is Mr. Jack Ruby. I am under the impression that Marina was threatened---- ++++++++++++++++++++++++++++++++++++++++++++++++++ "And I was a little suspicious of Mrs. Paine. I was suspicious of Mrs. Paine from the time I entered her home."

Reference is made to my letter of February 7, 1964 advising you that an agent of this Bureau displayed a photograph of an individual to Mrs. Marguerite Oswald on November 23, 1963. Mr. Howard Willens called and asked if we could make arrangements to have a copy of the photograph shown to Mrs. Oswald displayed to the commission.
This will confirm that on February 11, 1964 a copy of the photograph requested was delivered to the Commission.

Full Face and Just ShouldersOn Feb 12 th, Marguerite was back on the stand to discuss the Odum picture. Rankin was ready with CE 237 provided by the FBI. When shown to her, she adamantly denied that to be the picture Odum had. She insisted the picture she was shown was "full face and just shoulders"The above photo is from the Fort Worth, Star Telegram, 11/25/63 It was released by the Justice Dept to the Associated Press. That is an FBI photo of Jack Ruby, full face and shoulders. The above photo was probably what Marguerite saw on the folded newspaper that Tuesday. Although the face was similar to the CIA image, the description she gave, "big face and shoulders" "face took the whole picture", does not adequately describe Odum's cut out. Her description sounded more like the FBI-Ruby picture above. ++++++++++++++++++++++++++++++++++++++++++++++++++ Marguerite Oswald | Feb. 12, 1964Mr. RANKIN. Mrs. Oswald, all I have is Exhibit 237. in the shape it is in. And I will hand it to you and ask you if you recall that as being the picture that was shown to you. Mrs. OSWALD. No, sir. This is not the picture shown me. The picture that was shown me was a full face and just shoulders. This is not the picture. This picture was about this size, very glossy black and white, with a big face and shoulders. I have background here, a lot of white. But this took the whole picture the face and shoulders. And this door was just ajar. And this man had this picture and the two corners were cut. Mr. RANKIN. About what size is the picture you are looking at? Mrs. OSWALD. That is about three by four--approximately three by four, cupped in this man's hand, and the two comers were cut. The two top corners. And a very glossy picture, black and white, with a big face and shoulders. This is not the picture shown me, sir. Now, at Six Flags Inn, about 3 days later, when I entered the room, on the table were a lot of newspapers. I walked into the room in the presence of my son, and all of the agents. As I stated before, Marina and I knew nothing of what went on. We did not know how Lee was shot or anything, because we did not sit down and watch television. Mr. RANKIN. What son are you talking about? Mrs. OSWALD. Robert. So this is approximately the Wednesday, the 25th--no--- Sunday was the 24th About the 26th--it was a few days after Lee was shot, a couple of days. So I walked into the room, and I picked this paper up and turned it over, and I exclaimed, "This is the picture of the man that the FBI agent showed me." And one of the agents said, "Mrs. Oswald, that is the man that shot your son." Believe me, gentlemen, I didn't even ask his name. And nothing more was said. He's One of YoursThe Win Scott LetterOn November 22, 1963, CIA Officer, Winston Scott, sent a letter to CIA Chief, Col J C King. Scott reminded his superior of a conversation he had requesting permission to release a photograph of the mystery man, a picture from the Soviet Embassy at Mexico City, at a time Lee Oswald was supposed to have been there. Winston Scott was the Mexico City, Station Chief, and ex-FBI. His request to the Chief of the Western Hemisphere, that day, is a clear indication these agencies already knew the identity. These photos were sent to the FBI in Dallas. That Legal Attache would've carried the information on these photos. And probably more than the information stamped on the back. Scott asked permission. And Dallas FBI would've insisted on identity and background. It was one of these images Bartwell Odem cropped and had shown Marguerite Oswald. FBI was asking a witness if she ever saw the suspect with someone...that was, CIA. 230 Mexico City CIA station's surveillance photo's of Lee Harvey Oswald"Also of relevance is why the CIA worked so hard behind the scenes to try to keep the Warren Commission from publishing a photo of this supposedly unidentified person, even after receiving assurances that the background would be cropped out (the suggestion was even made that perhaps the face could be altered)." Attached are copies of each of the photographs we have with the dates of the visits stamped on the back.
At 6 p.m. Mexico time on 22 November, The Ambassador decided that this was important enough to have a member of the Legal Attache's office take copies of these pictures to Dallas, Texas. The Naval Attache is making a special flight from Mexico City for this purpose. The Legal Attache's officer who is going to Dallas has promised to mail the material to you for me.
Copies of the photographs are also being sent by pouch which will arrive Mexico City on the night of 22 November 1963.

The report concluded these pictures were taken between July - Nov. 1963 Yet Winston Scott's memo described time stamps on the back of the images. Time stamps, when Lee should have been there. How could there be any doubt about time? These photos were hand pouched express by the consulate's Legal Attache, to the FBI. The FBI's receipt included important information, but more decisively, if not identified, demonstrate, a concerted effort from the agencies to conceal facts. Is this about an agent Oswald? Hoover: "No, that’s one angle that’s very confusing, for this reason—we have up here the tape and the photograph of the man who was at the Soviet embassy, using Oswald’s name. That picture and the tape do not correspond to this man’s voice, nor to his appearance. In other words, it appears that there is a second person who was at the Soviet embassy down there." Jack Ruby, FBI-PCI in town, visited someone that Regis refuses to name. It is disturbing to see the FBI, directly involved, and refusing to cooperate. If it was a Ruby picture - The FBI have some knowledge of an Oswald-Ruby connection. If it was Mystery Man - The FBI have some knowledge of an Oswald intelligence connection.

Speculation and RumorsSpeculation.--Mrs. Marguerite Oswald was shown a photograph of Jack Ruby by an FBI agent the night before Ruby killed her son.Commission finding.--On the night of November 23, 1963, Special Agent Bardwell D. Odum of the FBI showed Mrs. Marguerite Oswald a picture of a man to determine whether the man was known to her. Mrs. Oswald stated subsequently that the picture was of Jack Ruby. A final suggestion of a connection between Jack Ruby and Lee Harvey Oswald arises from the testimony of Oswald's mother, Marguerite Oswald. When appearing before the Commission, Mrs. Oswald related that on November 23, 1963, before Ruby shot Oswald, FBI Agent Bardwell D. Odum showed her a picture of a man she believed was Jack Ruby, and asked whether the man shown was familiar to her. Odum had first attempted to see Marina Oswald, but Marguerite refused to allow Marina to be disturbed at that time. 1194 In the course of Marguerite's testimony, the Commission asked the FBI for a copy of the photograph displayed by Odum to her. When Marguerite viewed the photograph provided the Commission, she stated that the picture was different from the one she saw in November, in part because the "top two corners" were cut differently and because the man depicted was not Jack Ruby. 1195The Commission has investigated this matter and determined that Special Agent Odum did show a picture to Marguerite Oswald for possible identification but that the picture was not of Jack Ruby. On November 22 the CIA had provided the FBI with a photograph of a man who, it was thought at the time, might have been associated with Oswald. To prevent the viewer from determining precisely where the picture had been taken, FBI Agent Odum had trimmed the background from the photograph by making a series of straight cuts which reduced the picture to an irregular hexagonal shape. 1196 The picture which was displayed by the Commission to Marguerite Oswald was a copy of the same picture shown her by Agent Odum; however, in supplying a duplicate photograph for Commission use the FBI had cropped the background by cutting along the contours of the body of the man shown, 1197 resulting in a photograph without any background, unlike the first photograph Marguerite viewed on November 23. Affidavits obtained from the CIA and from the two FBI agents who trimmed the photographs established that the one shown to Mrs. Oswald before the Commission, though trimmed differently from the one shown her on November 23, was a copy of the same picture. It was the photo on the left, full face and shoulders, something Marguerite described. Instead the WC put into the record 2 unrelated Ruby pictures. The forewarning from Hoover, outlined in CE 3028 gave no confirmation of which picture Odum displayed. The Odum picture was cut differently and was not produced until July. Helms Affidavit and others are useless, explaining the pictures were taken sometime between July and Nov. 1963. It is a lie. These pictures had time stamps on the back. The other affidavits came 6 months too late in an effort to document actions that should have been clarified in February.

Affidavit Go 'round Odum Affidavit | July 10, 1964Bartwell Odum was the FBI Special Agent that cropped the photo then attempted to show it to Marina, when that failed, he showed it to Marguerite. She did not recognize the man. All the men consistently call Mystery Man, this "unknown individual", but only Malley may actually not know. An FBI SA that suspected an accomplice or a Lee Oswald imposter, would know. Asking a question, suspecting an answer, is attempting to get a confirmation of fact. I desired to show this photograph to Marina Oswald in an attempt to identify the individual portrayed in the photograph and to determine if he was an associate of Lee Harvey Oswald.Malley Affidavit | July 14, 1964James Malley, was the FBI Inspector that created and transmitted the picture to the commission. He did it the day after Marguerite brought this up, had she not, it would have remained buried. Upon further review of FBI files, he noted an additional copy, cropped in a different shape by Bartwell Odum. He swore in his affidavit, the identity of this unknown individual, has not been established. It is quite possible at the FBI Inspector level of James Malley, he did not know who this man was. "To my knowledge, the identity of the unknown individual depicted in the copy of the photograph which I transmitted to Mr. Willens on February 11, 1964, has not been established."Helms Affidavit | August 7, 1964Richard Helms was Deputy Dir. of Plans for the CIA. He most certainly would have known, at least, who to ask. Did he ask Winston Scott? Or JC King? Those CIA top officials knew who this man was. Commissioner Allen Dulles was the former Director of the CIA.
