A Series of QuestionsMr. POTTS. "Well, there is an anteroom before you get to the showup stage. Now, the witnesses were out front behind this transparent black nylon screen. There's a light set at an angle on the stage where the person on the stage can't see the people out in the audience."

There is a black square on the floor and he tells each one of them to take one step forward and they have a microphone above, and I don't recall exactly what he asked them--It was just to get them to talk and identify themselves. We conduct them different--sometimes we ask them their names and their address and their occupation." Did they ask Lee his place of employment? Even at this early stage, the simple answer Texas School Book Depository has obvious consequences. The PO participants are allowed to answer anything at all, Lee is required to tell the truth. Mr. Perry: I gave him all fictitious answers. I don't recall what they were, but they weren't---- Mr. Clark: No, sir; they were all fictitious answers. Mr. Ables: When he asked where I was from I told him Dallas. I don't recall what I told him when he asked my occupation. Occupation? - is that what you do? - or when you're a simple clerk, is that about where you do the work? What do you say when you're Lee Oswald? - A shipping clerk for school books? What do you suppose the next question will be? When the fillers gave their occupations, did they say where? take a look above, no one seems to recall....and Ball is very careful not to pursue this, he does not ask the fillers what Lee was asked. He does ask the administrators, unfortunately they don't remember. They are sometimes referring to notes, but simply don't remember ANY of the specific questions he was asked or answered. Not a one.
Mr. GRAVES. If they did, I don't remember what was said. I am reasonably sure they asked some questions. That is the usual procedure. If they were at this point I just don't remember what was said. Mr. SIMS. I couldn't say the exact questions, but as a rule, his age and address and where he went to school and where he was born and just a few questions like that, just to have them say a few words Mr. LEAVELLE. Normally, I would not have asked names in this case because for fear of her remembering the name, so, or might have heard the name, so, probably asked how old they were, what occupation, anything so they could speak and let me hear the sound of their voice.

What exactly are they asking these men?Mr. Ables: Where I went to high school. Mr. Clark: Name, address, occupation. Mr. Perry: I believe he asked me what kind of car I drove if I'm not mistaken. A prisoner from the fourth lineup was a bit more forthright...Daniel Gutierrez LujanMr. Ball: And did you tell him your name? Mr. Lujan: Yes, sir. Mr. Ball: Did he ask your occupation? Mr. Lujan: Yes, sir. Mr. Ball: What did you tell him? Mr. Lujan: Working for S. & F. Meat Co Mr. Ball: Ask you anything else? Mr. Lujan: No, sir; that's all. Phone number. There is no record of the DP filler's specific responses to the questions of occupation. Some may equate occupation with profession. OR for some "It's just my job at--"
In a menial job such as Lee's or a meat co. like Daniel Lujan, one may not consider that an occupation. And when answering "I'm a shipping clerk"...it's just as easy and expected to add... "at TSBD"There is no reason to think Lee Oswald was not asked where he worked. These men were asked many other things. The record is clear to take an effort that does not demonstrate a transparency regarding this matter.

The Davis Sisters | In -LawBarbara and Virginia DavisTwo young women, Barbara Jeanette Davis and Virginia Davis, were in an apartment of a multiple-unit house on the southeast corner of 10th and Patton when they heard the sound of gunfire and the screams of Helen Markham. They ran to the door in time to see a man with a revolver cut across their lawn and disappear around a corner of the house onto Patton. Barbara Jeanette Davis assumed that he was emptying his gun as "he had it open and was shaking it." She immediately called the police. Later in the day each woman found an empty shell on the ground near the house. These two shells were delivered to the police. [WCR page 168]These two are inside the house, so they don't see the shooting, and they both run to the front door. There are inconsistencies in their stories before the commission. These women do not testify together, although they viewed the lineup and conclusions together Virginia Davis testified April 2, 1964 with attorney Belin. Barbara Davis testified with Attorney Ball, March 26th. Below is a combination of testimony following the same line of questioning to show the contrastMr. Ball: When you went to the door, did you open the door? Mrs. Barbara Davis: I opened the door and held the screen opened…. I was standing on the porch. Mrs. Virginia Davis: It was closed. We was looking through it. Mr. Ball: Did he look at you?Mrs Barbara Davis: He looked at her first and looked at me and then smiled and went around the corner. Mrs. Virginia Davis: No, sir; not that I remember. I don't think so. Mr. Belin: Did you notify the police before or after you saw 'the boy with the gun? Mrs. Virginia Davis : Let's see, I think it was before. Mrs. Barbara Davis: I went back in and phoned the police. Mr. Ball: Was he dressed the same in the line-up as he was when you saw him running across the lawn? Mrs. Barbara Davis: All except he didn't have a black coat on when I saw him in the lineup. Mrs. Virginia Davis: He had on a light-brown-tan jacket. There are also inconsistencies in the number of shells that were found, when they were found, and by whom. The phone number given by these two on affidavits (11/22) was found on an incoming message pad of Ruby associate, Larry Crafard Herbert Blenner discusses that in "A Dirty Little Company"let's go to the lineup...

The Davis sisters attended the 3rd lineup at 7:30p Friday night.Barbara and Virginia Davis described the man they saw as a white male, slender, light complexion, with either light brown or black hair. The fillers for this lineup are Richard Walter Borchgardt, Ellis Carl Brazel and Don Ables (button down sweater) Assistant Council Sam Stern is questioning DPO Richard Sims. Mr Richard Sims Dallas Police Dept Yes, sir. Richard Walter Borchgardt, he is 23 years of age, 5' 9", 161 pounds, blue eyes, blond hair, and ruddy complexion. Ellis Carl Brazel [spelling] B-r-a-z-e-1, he"s 22 years of age, 5' 10", 169 pounds. Now, this weight could be one way or the other because this was at the time that they were arrested when they got this description. Once again he knows he's heavy on the weight, and tries to qualify it, then Sims admits there are 2 BLONDE fillers in this lineup.Mr. Stern: This information was obtained from police records? Mr. Sims: Yes, sir. He (Brazel) has green eyes, blond hair, and ruddy complexion. Stern immediately changes the subject to TSBD. Virginia knew the men didn't match what she had seen run across her lawn - too heavy - or too blond. There's only four men up there, why is one short and chubby? How is there two blonds, how is that fair?Virginia DAVISWell, one of them was sort, well, he was tall and slim. And then the other one there, he was sort of chubby and he was short. Then this other one, he was about the same height as the other one, the last one I told you about, short and chubby. And the other one was about--medium tail. Saw Lee ON TV (Virginia)Mr. BELIN. Later did you ever see a picture of Lee Harvey Oswald on television? Mrs. DAVIS. Yes, sir. Mr. BELIN. Did this look, could you tell whether this was the same man you saw running with the gun? Mrs. DAVIS. I wouldn't say for sure. They identified the man they saw on TV. The bigger problem is these two are viewing together, and in proximity to hear each other.Virginia DavisMr. BELIN. How did you identify him? Did you yell that this is the man I saw? Mrs. DAVIS. No; I just leaned over and told the detective it was No. 2. Mr. BELIN. Where was the detective? Was he to your right or to your left? Mrs. DAVIS. Let's see, to my right. Mr. BELIN. Where was your sister, to your right or to your left? Mrs. DAVIS. Right. Mr. BELIN. As she was to your right, so you leaned over to the detective and told the detective it was No. 2? Mrs. DAVIS. Yes, sir. Barbara DavisMr. Dulles. Did your sister-in-law, to your knowledge, make the same identification? Mrs. DAVIS. Yes, sir; she was there with me at the same time. Mr. DULLES. She was standing with you. And she saw the identification you had made? Mrs. DAVIS. All I done was just lean over and tell the man. Mr. DULLES. How did you make your identification? By pointing or holding up your fingers. Mrs. DAVIS. The man that was sitting next to me just asked me which one I thought it was, and I leaned over and told him. And then he leaned around me and asked her. Mr. DULLES. He did what? Mrs. DAVIS. He leaned around--he was behind me, and asked her. Mr. DULLES. I see. Mrs. DAVIS. I sort of set up where he could talk to her. Mr. DULLES. And did you identify the man by number or by pointing? Mrs. DAVIS. By number. Mr. DULLES. Do you remember what number it was? Mrs. DAVIS. It was number 2. From the left. Representative FORD. Did you whisper this information to the man behind you? Mrs. DAVIS. Well, we were all sitting in a line, and he was sitting on this side of me. He just leaned over and asked me which one I thought it was. Representative FORD. He was sitting on your right? Mrs. DAVIS. Yes. Representative FORD. And you turned to your right and told him? Mrs. DAVIS. Yes, sir. Representative FORD. And your sister-in-law was sitting on your left? Mrs. DAVIS. On the other side, yes. Representative FORD. When you spoke to him, you were speaking away from her? Mrs. DAVIS. Yes, sir. Representative FORD. Did you speak in a loud voice or a whisper? Mrs. DAVIS. No, sir; very quietly. Representative FORD. You think your sister-in-law heard you say the number? Mrs. DAVIS. I don't know. No matter how the WC tries to qualify this, it is blatant. Witnesses in a process openly identifying the suspect having influence on each other.
The lineup stacked with short and chubby guys, two are blondes. Lee still in a T-shirt, cuts and bruises on his face. They saw Lee on television, and that was the man they chose. Meanwhile, none of these match their original descriptions, nor do they even match each other.
DO NOT Allow multiple witnesses to view the same lineup together.
DO NOT Use lineup "fillers" who did not resemble the suspect, thus making the suspect stand out. "Fillers who do not resemble the witness’s description of the perpetrator may cause a suspect to stand out."NIJ: providing fillers for police lineups.

B.M. "Pat" PattersonPhoto Lineup BM Patterson, Warren Reynolds, and LJ Lewis were on Johnny Reynolds' Car lot on West Jefferson, when they heard the shots. On January 21, 1964 Patterson was interviewed by the FBI, the summary of that interview implied this misrepresentation of facts "As the individual reached Ballews Texaco Service Station located in the 600 Block of Jefferson, the individual made a turn in a northerly direction and proceeded behind Ballews Texaco Service Station where the individual discarded a jacket which was later recovered by the Dallas Police Dept." Patterson (BM) Exhibit AYet neither Reynolds or Patterson have ever acknowledged seeing the fleeing man discard his jacket.The final paragraph of the summary states: "PATTERSON was shown a photograph of LEE HARVEY OSWALD at which time he identified said photograph as being identical with the individual he had observed on the afternoon of November 22, 1963, running south on Patton Avenue with a weapon in his hand." on 1/21/64 at Dallas, Texas File # DL 100-10461 | By Special Agents VERNON MITCHEM and JOHN THOMAS KESLER - Date dictated 1/22/64 ++++++++++++++++++++++++++++++++++++++++++++++++++ On August 26, 1964 Patterson disputed both of these claims in an affidavit directly to the commission:PRESIDENT'S COMMISSION ON THE ASSASSINATION OF PRESIDENT JOHN F. Tippit, and the assassination of President John Fitzgerald Kennedy. I have been shown the written report of the results of this interview by Special Agents John T. Kesler and Vernon Mitchem of the Federal Bureau of Investigation, on January 22, 1964.* While this transcription is basically and materially correct, I desire to make the following clarifications in regard to the contents of this report. What is a Photo Lineup?"A photo lineup, also known as a photo array and or photo display, is a procedure used by law enforcement personnel to discover or confirm the identity of a criminal suspect. Generally a police officer shows a set of photographs to a victim or witness and asks whether he or she recognizes one of the persons in the photo-graphs as the perpetrator. A positive identification of a suspect can be used to place the suspect under arrest, and the act of identification may be used later as evidence in the prosecution of the defendant." see Photo Lineup++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++ WC Report"Patterson, when asked later to confirm his identification by affidavit said he did not recall having been shown the photograph. He was then shown two photographs of Oswald and he advised that Oswald was "unquestionably" the man he saw." (pg. 171)Once again the report misrepresenting the fact, BM Patterson is not only asking to confirm photo ID, he is requesting changes to wording of his report going in the record. WC did not make the requested changes.
We don't know what photo lineup Patterson was given in January. He doesn't remember one. The photos he was shown were stacked against Lee, and as noted below, broke similar guidelines as in-person lineups. Photo Lineup
"Police officers typically avoid suggestive photo lineups because they are interested in apprehending the right person. Toward this end, they may ask a witness to look at more than one photo lineup containing the suspect to see if the witness can identify the suspect more than once. Each photo lineup may contain as many as six or more photographs of different persons. Furthermore, to be effective, a photo lineup should contain pictures of persons who look similar to the suspect. For example, if police suspect a Caucasian male and a witness remembers seeing a blond, light-skinned male, the photo lineup will not consist of five pictures of dark-haired, dark-skinned males and one picture of the suspect." The photos they eventually show him are a mug shot and a BY photo with a rifle....nothing suggestive there - huh?.
Time is something the WC doesn't have a lot of. August 1964. Mark Lane sent a team of investigators to Oak Cliff for interviews and brought on a new set of questions re: a 2nd assailant. General Walker has started his own investigation and has spoken to Warren Reynolds and others. The day after Reynolds told the FBI he wasn't sure he saw Lee Oswald, he was shot in the head. He survived to testify. Meanwhile, Walker said to the WC:"...that people would like to shut up anybody that knows anything about this case. People right here in Dallas."
So when BM Patterson is shown two obvious photos and asked, "Was this the man you saw?" A question being kicked up again in the neighborhood, while Warren Reynolds just testified a few weeks before.
Do you suppose he would think of what happened to Reynolds? ...and just tell'em what they want. The August stacking of the backyard photo and the arrest photo, without any other choice of suspect, is blatantly bias and suggestive.

Harold RussellNearby witnessAnother witness, Harold Russell throws doubt on both Reynolds and Patterson's accounts of chasing the man. In an affidavit on January 22nd, same date as the others, he questions the quality of what they could see. RUSSELL advised approximately five minutes later Dallas police officers arrived, at which time he informed them of the general direction in which the person apparently responsible for the shooting had gone and also the fact that WARREN REYNOLDS and PAT PATTERSON, employees of Johnny Reynolds Used Car Lot, had attempted to follow the individual as he headed west on Jefferson Street. on 1/21/64 at Dallas, Texas File # DL 100-10461 By Special Agents JOHN T. KESLER and VERNON MITCHEM - LAC Date dictated 1/22/64 ++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++ Harold Russell told the FBI, Patterson went with him to the murder scene at Tenth and Patton. - but what about the chase, and Reynolds? Look at the words...."had attempted to follow"...it would seem less than half hearted chase, and that would lack of confidence for a photo line up. AND how close could you pursue a man with a gun, how good a look could you really get? -- or do you just go up to 10th ST. Russell was shown the above photo from New Orleans, from the previous August, the photo had already failed Scoggins. Russell identifies it as, the man he now knows to be Lee Harvey Oswald. What we don't know is, how was it asked, how was it lead into? BM Patterson never saw a photo lineup on the 22nd, yet the FBI lied when they said he identified Lee. When he insisted in an August '64 affidavit, directly to the WC, to make change to his statements, they refused. Instead, the FBI showed him a photo lineup of the notorious BYP and a face beaten mugshot. So eight months after Warren Reynolds was shot in the head, BM Patterson identified Lee Harvey Oswald. WCR page 652-3 - Appendix 12: Speculations and Rumors IOW - facts that could not be substantiated by the WC.
"Two other men, Warren Reynolds and Pat Patterson, saw a man with a pistol in his hand running south on Patton Avenue.
They followed him for a block on Jefferson Boulevard and then lost sight of him. " [this is directly contradicted by Harold Russell]
Harold Russell said he and Patterson went up to 10th St. Neither Patterson or Russell were called before the commission.

Warren ReynoldsUsed Car SalesWarren Reynolds was on the used-car lot located on the southeast corner of this intersection of Patton Avenue toward Jefferson Boulevard. This is a remarkable story, here is guy that was shot in head and survived to testify. It started Jan 22, 1964, Reynolds was given a photo lineup, same days as the others. He told the FBI he couldn't be sure it was Lee. +++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++
The next day, a man was hiding in the basement of the car dealership where he worked. When he went down to closeup, he was shot in the right temple, exited behind his left ear. The bullet went thru his head. He testified as late as July 22nd. Liebeler is the questioning attorney, very sharp, but like he doesn't believe it, or he's trying to talk him out of it.
Reynolds speaks out that there was no followup investigation, Liebeler insists the shooting was a disgruntled customer. Reynolds, mentions his daughter's attempted kidnapping, and porch light taken out. Liebeler ignores both.
Mr. LIEBELER. Would you tell us the circumstances in which that happened? Mr. REYNOLDS. I know this man was waiting for 3 1/2 hours in a basement where I work. Mr. REYNOLDS. At the car lot, the Johnny Reynolds Co. And when I went down to turn off the lights in, this basement where he had taken the light globe out of the room, I went in there more or less in the dark to turn off the light. It is a switchboard, and when I walked up to it and turned two switches, this man couldn't hardly have been over a foot from me with the rifle, and shot me.
When he shot me, I ran upstairs. I went around to the right about 20 feet and got this towel to, of course, stop the blood, and when I turned around to go call the police, I had assumed all the time that I had been electrocuted for some silly reason, never dreaming I had been shot. But when I saw the man run off, I figured right then I must have been shot, so I ran on in and called the police. (Incredible) Watch Liebeler, instead of listening to what the man says, he starts throwing out particulars that contradict what Reynolds is saying, Like he's trying to talk him out of it. I won't post the entire testimony, but the reader can check it out directly, it is a fast read.
Mr. LIEBELER. Would it surprise you to know that on January 23 he apparently told the Dallas Police Department that Garner had been in the car lot on January 20 and tried to trade a 1957 Oldsmobile for which he did not have a title, and became extremely upset when he, Johnny Reynolds, wouldn't purchase the automobile from Garner? Mr. REYNOLDS. I had to keep in mind that it is possible that that had happened and I just didn't, I mean I have been through an awful lot these 6 months, and it is possible that I have just missed it, but I would say I would be a little bit surprised.
Mr. LIEBELER. For the purpose of our investigation, I mean if there were any connection between your shooting on January 23 and Oswald's arrest for the assassination, we want to know about it. That is perfectly clear, is it not? Seems rude.Mr. REYNOLDS. Yes. Mr. LIEBELER. I am asking you if you have any facts that would tie it up. Mr. REYNOLDS. I have no facts. I just have my own beliefs. means nothing to Liebeler.Mr. LIEBELER. And you do believe that there is some relation, do you? Mr. REYNOLDS. Yes Mr. LIEBELER. I think I have asked you all the questions I can think of, Mr. Reynolds, at this point. But I do want to say this to you. If you can think of anything else that you want the Commission to know in connection with this whole thing, I want you to feel free to say what it is right now. Or if you think there are any other facts that relate to this that we haven't brought out. Mr. REYNOLDS. I don't know of any. I think it should be investigated what happened to me. Apparently it wasn't, and Liebeler has been able to dismiss it in to the record without any real investigation connecting McDonald to Ruby.
and there is this, Mr. REYNOLDS. Someone unscrewed my light globe one night on the front porch of my house, and someone definitely did it. Whether it was a jokester or kid, but I have a lamp over the light. They had to take three screws loose to get to my light globe.
They took those off unscrewed my light, and that is for sure. Now, that was around the 20th of February, too.
There is no proof Garner shot Reynolds re: a disgruntled trade in. There is no full investigation into the matter, the porch light out,
or the daughter attempted kidnapping. More importantly there is NO mention in his testimony of Harold Russell, or BM Patterson. Not a word. Neither were called, and Reynolds does not support the record alone.

General Edwin Walkerfrom Wiki:On April 10, 1963, as Walker was sitting at a desk in his dining room, a bullet struck the wooden frame of his dining room window.
Walker was injured in the forearm by fragments. Marina Oswald later testified that her husband told her that he traveled by bus to
General Walker's house and shot at Walker with his rifle. Marina said that Oswald considered Walker to be the leader of a "fascist organization." It's a thread about lineups, I know.
I bring the General in because, Reynolds is frustrated about getting no answers re: who shot at him, and Walker is conducting his own investigation around Dallas.
I would remind the reader to pay attention to the difference in Liebeler's manner and tone between these two witnesses Even though they are saying the same thing, and one would expect more respect to an Army General. It's Reynold's words that get no respect.
Which is even more incredible, considering he's the one shot in the head.
General WalkerMr. LIEBELER. Did Reynolds tell you that he thought there was some connection between the attack on him and Oswald killing Tippit? General WALKER. We discussed that. Mr. LIEBELER. Did he tell you that he thought there was a connection between the two? General WALKER. He seemed to think there might be. Mr. LIEBELER. Do you think there is? General WALKER. Yes; I do. Mr. LIEBELER. Do you have any evidence to indicate that there is? General WALKER. I think there is a definite I don't know that you could call it evidence but you can anticipate that people would like
to shut up anybody that knows anything about this case. People right here in Dallas. And I don't think anybody knows or would have
known at the time after November 22 how much or how little Warren Reynolds knew. Mr. LIEBELER. In fact, he doesn't know very much, does he? General WALKER. He would become a very good example, regardless of what he knew, to let everybody know that they better keep their mouths shut. Warren Reynolds was just trying to find out who shot him, and why. He never did get that answer.

Here we are again. Appendix 12: Speculations and Rumors. July 1964, and the WC will have to finish some time (this year).
Warren Reynolds was shot by a man named Darrell Wayne Garner.
When it came time for trial, a stripper named Betty McDonald stepped up and gave Garner an alibi and he was released. A few weeks later McDonald was arrested for disturbing the peace, and later was found hanged in her cell.
Rumors spread McDonald was connected to The Carousal Club and Jack Ruby.

Speculation.--The shooting in Dallas on January 23, 1964, of Warren A. Reynolds, who witnessed the flight of Patrolman Tippit's slayer on November 22
and followed him for a short distance, may have been connected in some way with the assassination of President Kennedy and the slaying of Patrolman Tippit.
A man arrested for the attempt on Reynolds, Darrell Wayne Garner, was released as a result, in part, of testimony by Betty (Nancy Jane Mooney) MacDonald,
who had allegedly worked at one time as a stripper at Jack Ruby's Carousel Club. Commission finding.--This rumor, originally publicized by a newspaper columnist on February 23, 1964, was apparently based on the alleged connection
between Betty MacDonald and the Carousel Club. Investigation revealed no evidence that she had ever worked at the Carousel Club.
Employees of the club had no recollection that she bad ever worked there. Betty MacDonald was arrested and charged with disturbing the peace on February 13, 1964.
After being placed in a cell at the Dallas city jail, she hanged herself. The Commission has found no evidence that the shooting of Warren Reynolds was in any way related
to the assassination of President Kennedy or the murder of Patrolman Tippit.111 (WCR page 663) One foot note 111 11 H 434-442 (Warren A. Reynolds); 8 H 2579, 2587, 2588CE 2579Appears to be an FBI report re: the exaggeration of a newspaper story in the heat of the moment. Without having one specific to this story, a likewise was used. It is worthless, and provides no evidence to dispel Reynold's suspicions about the shooting.

Though one document later (not listed), Garner admits to the shooting to his sister-in-law, and McDonald says she's one of Jack's girls. Mark Lane"Garner was actually arrested twice. Ms. Mooney was responsible for his final release. The FBI report reveals that on Feb 05, 1964 Miss Mooney advised
Detective Ramsey, Dallas Police Department, she had worked as a stripper at Jack Ruby’s place. Detective Ramsey’s statement was cooperated by Patsy Swope Moore,
Ms. Mooney’s roommate. She told the FBI that Ms. Mooney had informed her that she had been employed as a stripper. Ms. Moore added she could specifically recall that
Ms. Mooney said she entertained at Jack Ruby’s Carousel." [Rush to Judgement page 278]
These are not mistakes but are intended to mislead and distort the facts regarding a further shooting in this case.
The WC claims WR was shot by a disgruntled customer, who? Darrel Garner denies the shooting after already admitting it to his sister in law. He was released.
No reason was ever given to Reynolds in the conclusion of this investigation, or further study into his daughter attempted abduction or porch light out.
Warren Reynolds hesitated to identify Lee Harvey Oswald, and was later shot in the head. Gen. Walker reminds the WC, people are scared. Other witnesses in the area that may have heard Reynolds has testified, are now being asked to identify Lee Oswald, and are probably reminded of each other.
