Oswald’s Presence on Sixth Floor Approximately 35 Minutes Before the Assassination (WC Report page 144)
The Warren Commission tells us the last man to see Lee Oswald was TSBD worker Charles Givens.
“At about. 11:45 a.m. the. floor-laying crew used both elevators to come down from the sixth floor. The employees raced the elevators to the first floor. Givens saw Oswald standing at the gate on the fifth floor as the elevator went by. Givens testified that after reaching the first floor, “I discovered I left my cigarettes in my jacket pocket upstairs, and I took the elevator back upstairs to get my jacket with my cigarettes in it.” He saw Oswald, a clipboard in hand, walking from the southeast corner of the sixth floor toward the elevator…”
Mr. BELIN. Coming towards the elevators?
Mr. GIVENS. Yes, sir.
Mr. BELIN. Did you see all of his body or not?
Mr. GIVENS. Yes, sir; he had his clipboard in his hand.
Mr. BELIN. He had his clipboard in his hand?
Mr. GIVENS. Yes, sir.
December 2, 1963Givens, interviewed by the Secret Service, said that he had seen Oswald with a clipboard on the sixth floor at about 11:45 a.m., shortly after which he and some fellow–workers had boarded the two elevators. While racing to the first floor, Oswald had called to them to sent one elevator back up. (Ball/Belin Report No.1, dated Feb. 5, 1964). Again, Givens said nothing about a return to the sixth floor for his cigarettes at any time after the elevator race.Oswald’s Clipboard was found around Dec 02nd. |

It starts with Inspector Sawyer (DPD) issued an alert on the police radio at 1:46p for Charles Givens, a porter at the Book Depository, because he had “a police record and he left.” Oswald, too, had left the scene but no alert was issued for him.
Once in custody he signs an affidavit stating he had left the 6th floor about 11:30am –nothing about returning to the 6th floor and nothing about encountering Lee.CE 2003 page 27 “I work for the Texas School Book Depository, 411 Elm Street. I worked up on the 6th floor today until about 11:30 am. Then I went downstairs and into the bathroom. At twelve o’clock I took my lunch period. I went to the parking lot at Record and Elm street. I have a friend who works at the parking lot. We walked up to Main and Record when the President passed by. We then walked back to the parking lot after the President had passed by. We had just got back to the lot when we heard the shooting. I think I heard three shots. I did not see anyone in the building that was not supposed to be there this morning.” |

Later that day he talks to the FBI:
Again, nothing about returning to the 6th floor but now he mentions seeing Lee on the 1st floor at 11:50am. Two other employees can also confirm Lee in the Domino Room (downstairs) at this time:

Mr. BALL. On November 22, 1963, the day the President was shot, when is the last time you saw Oswald?
Mr. SHELLEY. It was 10 or 15 minutes before 12.
Mr. BALL. Where?
Mr. SHELLEY. On the first floor over near the telephone.
Eddie Piper Janitor, TSBD
Mr. BALL. Was that the last time you saw him?
Mr. PIPER. Just at 12 o’clock.
Mr. BALL. Where were you at 12 o’clock?
Mr. PIPER. Down on the first floor.
These sightings of Oswald on the first floor between 11:45 and 12:00 give credibility to Givens’ original account of seeing Oswald reading the newspaper in the Domino Room at 11:50am.
They also imply that Givens changed his story (under tremendous pressure) to say that he had not seen Oswald all day.

Feb 13,1964
Lt. Jack Revill (DPD) was interviewed by Robert Gemberling (FBI) about press rumors of a Negro being held in protective custody. Revill “stated that Givens had been previously handled by the Special Services Bureau on a marijuana charge and he believes that Givens would change his story for money.”
Yet almost three months later, there is still nothing from Givens, Revill, or the FBI about cigarettes forgotten by Givens or his return to the sixth floor and encounter there with Oswald.

March 18, 1964 Givens, furnishes another affidavit to FBI agents Trettis and Robertson, states: “I returned to the Depository Building, and was told by a Dallas policeman that I could not enter the building. About an hour later I went to the Dallas Police Department and was questioned by the police for about 45 minutes.”
Still again, no mention during the 45–minute interrogation of the cigarettes left and retrieved or of seeing Oswald on the sixth floor, nor were these alleged circumstances hinted at in the above March, 1964, affidavit to the FBI, four months after the assassination. AND he says he went back for his coat at 5pm.

April 8, 1964Charles Givens gives sworn testimony to the Warren Commission in a deposition taken by lawyer David Belin, with no one else present except the court reporter. Now, for the first time, Givens tells the story (later embodied in the Warren Report) about the cigarettes forgotten on the sixth floor and the encounter with Oswald (6H 345–356, WR 143).But Belin should have been fully aware that Givens had told a completely different story to the FBI and the police on the day of the assassination, and subsequently to the Secret Service and the FBI, since Belin had co–authored the report which discussed Givens’ accounts of his movements in considerable detail. But Belin did not challenge Givens’ new story nor place on record that on several earlier occasions Givens had sworn to a completely different account of his movements and actions on the day of the assassination.Indeed. in one oblique question, he asked, “Did you ever tell anyone that you saw Lee Oswald reading a newspaper in the domino room around 11:50 … that morning?” (6H 354). Givens replied, “No, sir,” which meant either that he was giving Belin a false response or that the two FBI agents who had interviewed him on Nov. 22 had invented Givens’ reported statement that he had seen Oswald in the domino room at 11:50 a.m.
Yet neither Givens nor the FBI agents were challenged or even queried in an attempt to determine which story was true and which was false.

Mr. RANKIN. You just knew about the someone by the name of Lee, didn’t you?
Mr. REVILL. Yes, sir; Lee. And this was told to me by a colored employee of the School Book Depository. Myself and Lieutenant Frank Dyson took charge of the search of the building and we must have had 75 or 80 men in the building assisting in this search. I talked to a Negro—-
Mr. DULLES. Were you in charge of that?
Mr. REVILL. Yes, sir; I was in charge of that phase of the search. I talked to a Negro by the name of Givens, and we had handled this person in the past for marijuana violations and I recognized him and in talking to him I asked him if he had been on the sixth floor, and as well as I recall, and Detective Brian was present at this same time he said, yes, that he had observed Mr. Lee, over by this window.
THIS IS A LIE –Givens never stated he had seen Oswald “over by this window” and had never said he had seen Lee until April 1964.

Mr. SAWYER. …. There is another broadcast in there somewhere, though. I put out another description on the colored boy that worked in that department.Mr. BELIN. What do you mean the colored boy that worked in that depository? Mr. SAWYER. He is one that had a previous record in the narcotics, and he was supposed to have been a witness to the man being on that floor. He was supposed to have been a witness to Oswald being there.Mr. BELIN. Would Charles Givens have been that boy? Mr. SAWYER. Yes, I think that is the name, and I put out a description on him.Mr. SAWYER. Somebody told me that. Somebody came to me with the information. And again, that particular party, whoever it was, I don’t know. I remember that a deputy sheriff came up to me who had been over taking these affidavits, …he came over from the sheriff’s office with a picture and a description of this colored boy and he said that he was supposed to have worked at the Texas Book Depository, and he was the one employee who was missing, or he was missing from the building. He wasn’t accounted for, and that he was suppose to have some information about the man that did the shooting.”

Was Givens already groomed or coerced into naming Oswald but smelled a rat and bailed out? The leads Sawyer's interview provided BELIN with were potentially explosive: Somebody reported to a deputy that Givens had information on the man who did the shooting. So who was that somebody that Givens possibly talked to and who was the deputy sheriff and why was Givens missing an issue? To my knowledge neither the "somebody" nor the deputy sheriff were named which should come as no surprise as the commission avoided leads that could point to Oswald being framed. Note that BELIN interviewed both Givens and Sawyer on the same day, April 8, 1964!!! This means he would have read up on the details concerning Givens being rounded up. Despite this, and given Givens very thin affidavit, BELIN does not ask Given any questions related to the APB and why he ends up writing an affidavit of basically zero value. And who reported Givens missing? It wasn't Truly (officially) because he reported Oswald missing, although he couldn't come up with any plausible explanation for doing so and eventually admitted he knew Givens was also missing. However, Truly saw Givens outside the TSBD just prior to the shooting so Givens having gone "missing" after the assassination had no relevance in relation to being directly involved in the shooting. The Givens missing thing is just BS.
Something was clearly wrong with this APB being issued and BELIN knew it.

Speaking of Givens....here is a couple of passages where he offers information that warranted at least some followup questions by BELIN:
Mr. BELIN. Do you remember what he was wearing?
Mr. GIVENS. Well, I believe it was kind of a greenish looking shirt and pants was about the same color as his shirt, practically the same thing he wore all the time he worked there. He never changed clothes the whole time he worked there, and he would wear a grey looking jacket.
Mr. BELIN. All right. You saw him at 8:30 on the first floor?
Not so fast BELIN!
Several days after Oswald had been shot his blue jacket was found in the domino room...surprise!
Evidently, if Oswald had worn the grey jacket on Thursday, going to Irving, and back on Friday he couldn't have picked it up later at the rooming house and -- allegedly -- dumped it in the Texaco parking lot. Did Givens recall Oswald ever wearing a blue jacket? Thanks to BELIN we'll never know.
Mr. BELIN. Did you ever notice any one person there he [Oswald] was more friendly with than the other?
Mr. GIVENS. Well, this boy he rode with.
Mr. BELIN. Frazier?
Mr. GIVENS. Yes, sir. Every once in a while I would see him talking to him. Bonnie Ray told me---I never saw him, but Bonnie Ray told me he talked to he and Danny sometimes.
Hmmm, so how often did he catch a ride with Frazier? Did Givens actually see Oswald entering or getting out of Frazier's car or was it something he just had heard of?
Officially this only took place during weekends (and he missed one weekend as I recall) so how did he get to and from work the rest of the week? The WC (and the FBI) provided no documentation what so ever as to how Oswald got to work when he was not with Frazier. Why???
